Terms of Service

Effective October 3, 2026

These Terms of Service (“Terms”) govern your use of Tend (“Tend”, “we”, “us”), the AI assistant at heytend.me and over text message, including the apps you connect to it (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service

Tend answers questions, remembers what matters to you, and, when you connect your accounts, reads and acts in them for you: email, calendars, documents, CRMs, accounting, project and marketing tools. It can also search the web, browse websites, and place phone calls on your behalf when you ask.

2. Your account

You must be at least 18 years old to use Tend. Your account is tied to your phone number; you are responsible for keeping your phone and sign-in codes secure, and for everything done through your account. Tell us at once at hello@heytend.me if you believe someone else has used it.

3. Connected apps and actions Tend takes

When you connect an app, you authorise Tend to access it through that app's own sign-in, within the permissions you grant there. Tend asks for your confirmation before it does anything that changes something, such as sending a message, editing a record or creating a campaign, and acts only after you agree. You are responsible for the actions you approve and for your use of each connected app under that app's own terms. You can disconnect an app at any time.

4. Acceptable use

You agree not to use Tend to:

• break any law or anyone's rights, including privacy, intellectual-property and anti-spam laws;
• send unsolicited bulk messages, make harassing or deceptive calls, or impersonate anyone;
• access accounts, systems or data you are not authorised to use;
• interfere with the Service, probe it for vulnerabilities without our permission, or get around its limits;
• create content that is unlawful, abusive or harmful.

5. Your content

You keep ownership of what you send to Tend and what it makes for you. You give us permission to store and process it only as needed to provide the Service to you, as described in our Privacy Policy.

6. AI output

Tend's answers are generated by AI and can be wrong or incomplete. Check anything important before you rely on it. Nothing Tend says is legal, financial, tax, medical, health or fitness advice; consult a qualified professional for those.

7. Third-party services

Tend works with services run by others, including the apps you connect and the websites it visits for you. We are not responsible for those services, their availability or their content, and your use of them is governed by their own terms.

8. Fees

Tend is free while it is in early access. If we introduce paid plans, we will tell you the price and terms before you are charged, and you can choose whether to continue.

9. Early access

Tend is in early access. Features may change, be limited or be removed, and the Service may be unavailable at times.

10. Our intellectual property

The Service, its software and its brand belong to us. These Terms do not give you any right to them beyond using the Service.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $100.

13. Indemnification

You agree to indemnify us against claims arising from your misuse of the Service, your breach of these Terms, or actions you approved Tend to take in your accounts.

14. Ending your use

You can stop using Tend at any time and ask us to delete your account. We may suspend or end your access if you break these Terms or if we need to in order to protect the Service or others.

15. Governing law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in California, unless the law where you live requires otherwise.

16. Changes to these Terms

We may update these Terms. We will post the new version here with its date, and tell you before a material change takes effect. If you keep using Tend after that, the new Terms apply.
